Seller

The seller is Elementz Nature s.r.o., with its registered office at Šafránkova 1238/1, Prague 13, 155 00, e-mail: shop@elementz.com, online store address www.elementz.com (“Seller”).

I. Introductory Provisions

1.1 These Terms and Conditions further define and specify the rights and obligations of the Seller and the consumer as the buyer ("Customer") when concluding a purchase contract through the Seller's online store.

1.2 A consumer is a natural person who, when concluding and fulfilling a purchase contract with the Seller, is not acting within the scope of his commercial or other business activity or within the independent exercise of his profession.

1.3 Legal relations between the Seller and the Customer that are not expressly regulated in these Terms and Conditions or in the purchase contract concluded between the Seller and the Customer are governed by the relevant provisions of Act No. 89/2012 Coll., the Civil Code, as amended ("Civil Code"), and Act No. 634/1992 Coll., on Consumer Protection, as amended ("Consumer Protection Act").

1.4 In the event of any discrepancies between these Terms and Conditions and the purchase contract concluded between the Seller and the Customer, the provisions of the purchase contract shall prevail, with the terms and conditions forming an integral part thereof.

II. Purchase contract

2.1 The subject of the purchase contract is the mail order sale of food supplements, cosmetics and/or other goods (“Goods”).

2.2 In order to order the Goods, the Customer shall complete an order. Before sending the order, the Customer shall be allowed to check and/or change the data added to the order. After completing the order, the Customer shall submit the order, thereby creating a purchase contract (however, ownership of the Goods shall only be transferred to the Customer upon full payment of the purchase price for the Goods and handing over the Goods to the Customer). Acceptance of the order shall subsequently be confirmed to the Customer by e-mail sent to the e-mail address that the Customer provided in the order (however, this e-mail confirmation shall not affect the creation of a purchase contract).

2.3 Before sending the order, i.e. before concluding the purchase contract, the Customer confirms that he has read these terms and conditions and that he agrees with them.

2.4 The resulting purchase contract (including the agreed purchase price) can be changed or canceled only on the basis of an agreement between the Seller and the Customer or for legal reasons. If the Customer has already paid the purchase price or part of it, this amount will be transferred back to his bank account without delay.

2.5 The Customer agrees to the use of distance communication means when concluding the purchase contract. The Customer shall bear the costs incurred by the Customer when using distance communication means in connection with concluding the purchase contract (internet connection costs, telephone call costs).

2.6 Any consumer rights (see below) cannot be applied to gifts that are provided to the Customer completely free of charge. These gifts are regarded as a gift.

III. Shipping and payment terms

3.1 VAT is being applied according to the country of destination and shipping is free.

3.2 Payment for the Goods can be made:

By online payment card – online payments are made via the secure payment gateway Comgate A safe and easy payment method for VISA and Mastercard cardholders. In the event of non-delivery of the goods, your payment will be refunded.

3.3 Any discounts applied when purchasing on the Seller's website cannot be added together. Only one discount (i.e. one discount code or coupon) can be applied per purchase. The right to a discount cannot be compensated in any other way. Discounts cannot be combined.

IV. Delivery period

4.1 The delivery period starts from the date of receipt of the order (in the case of cash on delivery) or from the date of crediting the purchase price to the Seller's account (in the case of online card payment and payment to a bank account) provided that all documents necessary for the timely processing of the order have been received. If the Goods are in stock, the Seller undertakes to dispatch or hand over the Goods to the carrier no later than 3 working days.

4.2 If the Goods are not in stock, the Seller will notify the Customer of the expected delivery date or offer him other comparable Goods. In such a case, however, the Customer will be requested to give written (by e-mail) consent. The delivery period is considered to have been met on time if the Goods are ready for handover no later than the last day of the agreed or additionally agreed delivery period.

4.3 The delivery times stated on the Seller's website are for information purposes only and do not guarantee delivery within these times.

V. Withdrawal from the purchase contract

5.1 In accordance with Section 1829, paragraph 1 of the Civil Code, the Customer has the right to withdraw from the purchase contract without giving a reason within 14 days of receipt of the Goods (if the subject of the purchase contract is several types of Goods, this period runs from the date of receipt of the last delivery of Goods). Withdrawal from the purchase contract must be sent to the Seller within the period specified in the previous sentence in writing by registered letter or electronically to the Seller's email address. Within 10 business days of the date on which the Seller receives the notice of withdrawal from the purchase contract, the Seller will inform the Customer about further steps.

5.2 The Customer is aware that the right to withdraw from the purchase contract cannot be used for some goods - it is not possible to withdraw from the purchase contract for the supply of (i) goods that are subject to rapid deterioration, as well as goods that have been irretrievably mixed with other goods after delivery, and (ii) goods in closed packaging that the Customer has removed from the packaging and cannot be returned for hygiene reasons (this applies in particular to food supplements).

5.3 As a sign of good will, the Seller extends the timelines shown in 5.1 to 30 days.

VI. Out-of-court settlement of disputes

6.1 According to the provisions of Section 20c of the Consumer Protection Act, each Customer has the right to out-of-court settlement of a consumer dispute with the Seller arising from the purchase contract.

6.2 The Czech Trade Inspection Authority, ID: 000 20 869, with its registered office at Štěpánská 567/15, 120 00 Prague 2, internet address: http://www.coi.cz. The online dispute resolution platform located at the Internet address http://ec.europa.eu/consumers/odr can be used to resolve disputes between the Seller and the Customer arising from the purchase contract.

6.3 Out-of-court dispute resolution is initiated at the request of the Customer, which the Customer is entitled to submit no later than 1 year from the date on which he exercised his right, which is the subject of the dispute, with the Seller for the first time.

6.4 Further information on the requirements for initiating a dispute and the manner of its conduct is set out in the provisions of Sections 20c to 20h of the Consumer Protection Act.

VII. Final provisions

7.1 These terms and conditions apply in the wording stated on the Seller's website on the day the electronic order is sent, unless otherwise agreed in writing between the Seller and the Customer.

7.2 By sending an electronic order, the Customer accepts without reservation all provisions of the terms and conditions in the wording valid on the day the order is sent, as well as the price of the ordered Goods (including shipping and transport costs, if applicable) stated on the website, valid on the day the order is sent, unless otherwise agreed in a specific case.

7.3 The Seller is entitled to change these terms and conditions.

7.4 These terms and conditions are valid from January 27th, 2026.

7.5 For the purpose of processing the order and fulfilling the concluded purchase contract, the Seller processes the Buyer's personal data in accordance with the principles described in detail in the document Personal Data Protection in the elementZ e-shop, which is available on the website www.elementz.com.
